Layers over above black background in IE7/8

The following DIV *should* appear above the black out background when a Pretty Window fires up:
I would like this to remain above black background when pretty photo comes up. Works in Firefox/Chrome/Safari only.
This works in Firefox, Chrome and Safari but not IE. In IE it remains darkened out with the rest of the page despite the 20,000 Z value here.
It needs to be locked to the right side of the browser but removing that doesn't help. It must appear over the black background created when the pretty photo window is activated. I have given it a z-index of 20000 and it works fine on all browsers except IE7 and IE8. In IE it appears below the back background. It must be able to work as the pretty photo itself is above the black background - I just need my object to also appear above the black background and at the same time be fixed to the right of the browser. Any ideas?
